Opt In

If you and/or your business were not domiciled in the UK on 19 October 2021, you must opt in by 07 November 2023 if you wish to be part of the collective claims against the defendants. By completing this Opt-In Form, you are requesting to opt-in to the relevant Claim(s). This means you could be included within the classes of individuals Mr Gutmann represents in the Claims, and you may be entitled to receive any money that may become available once the Claims are concluded. By opting-in, you will not be able to bring an individual claim of your own against the Defendants.

Please Note: If you or your business were domiciled in the UK on 19 October 2021 AND you meet the class member criteria, you do not need to opt-in. You will automatically be part of the class.

To opt-in to the relevant Claim(s), you must complete an Opt-In Form online or opt-in via post. To be valid, your Opt-In Form or letter must be received and/or postmarked by no later than 07 November 2023. If you do not opt-in by 07 November 2023 and money later becomes available, the only way for you to be eligible to receive a payment is for the Tribunal to give you permission to opt-in at a later time.

Please note that once you have completed and returned an Opt-In Form or sent a letter opting-in, you do not need to take any further action. You will receive a notification that your request to opt-in to the Claims has been received. This notification will be sent via email. If you did not provide an email address, you will receive a notification by post to the address you provided.


Option 1: Opt-In Form Online:

To complete your Opt-In Form online, you will be asked to provide your Class Member contact information and the dates of residency when you and/or your business were domiciled in the UK during the class period.

Option 2: Opt-In via post:

To opt-in via post, you may send a letter or use the preformatted form available here to the below address stating one or more of the following:

  1. “I want to opt-in to the collective claim against the South Western rail franchise, Case No.1304/7/7/19” and/or;
  2. “I want to opt-in to the collective claim against the Southeastern rail franchise, Case No. 1305/7/7/19” and/or;
  3. “I want to opt-in to the collective claim against the Govia Thameslink Railway franchise, Case No. 1425/7/7/21”.

This letter must include your full name, current address, email address, affirmation that you meet the class definition, signature, the relevant dates you were resident in the UK and the date you signed it. Please send your letter to the following address, postmarked no later than 07 November 2023 :

Opt-Out

SW/SE Claim:

If you were a UK resident on 19 October 2021 and you want to be removed from the class for either or both of the claims, send a letter to:

Include the following statement in your letter “I want to opt-out of the collective claim against the South Western rail franchise, Case No.1304/7/7/19” and/or “I want to opt-out of the collective claim against the Southeastern rail franchise, Case No. 1305/7/7/19,” along with your full name, postal address, email address and telephone number. Sign and date your opt-out letter. You do not have to give a reason for opting-out.

To be considered, your opt-out letter must be received by 07 November 2023. Once your opt-out is received and processed, you will be sent an acknowledgement by email if you have provided an email address, or by post if not. By opting-out, you will not be able to receive a payment from the claim(s) if money becomes available. However, you may be able to bring your own separate claim against South Western and Southeastern for the same issues.

IMPORTANT CONSIDERATION: Please note, if you opt-out and then wish to bring a claim on your own against South Western and/or Southeastern, you must do so within six months of the date on which you opt-out. If you do not file an individual claim within this timeframe, your claim will be time barred and not allowed.

TSGN Claim:

If you were a UK resident on 19 October 2021 and you want to be removed from the class, send a letter to:

Once your opt-out is received and processed, you will be sent an acknowledgement by email if you have provided an email address, or by post if not. By opting-out, you will not be able to receive a payment from this claim if money becomes available. However, you may be able to bring your own separate claim against GTR for the same issues.
